Alan R. Carlton, Esq. Nurses and the Anti-kickback Statute? When you hear about kickbacks and healthcare, it's usually in relation to large manufacturers or institutions. But the scope of the statute is not so limited. And as more nurse managers assume more authority over the purchasing decisions at the nation's 14,000-plus outpatient surgery centers, now's a good time to note that all healthcare professionals are subject to the act's provisions, and consequences of violation can be severe: huge fines, felony convictions and exclusion from participation in Medicare and Medicaid.
