Leasing an OR to another facility

Has anyone ever leased an OR/Procedure Room to another facility for use on a specific day of the week?
Our goal would be to allow this facility to use one of our procedure rooms during specific times and allow them to bill the facility fee, then pay us a fair rental fee.
Is this possible? Allowed by Medicare?

Such a practice, while desirable, is illegal in many states. Current CMS regulations allow such a practice in a CMS participating center IF it is consistent with state laws and if certain other specific criteria are met. States vary widely in their approach- it can be done in AZ if the other entity acquires a similar license at the same location; it cannot be done in FL under any situation. GA law allows for the licensing of multiple LNR (Single Specialty) centers at the same physical address-- but try getting past the inspector. MO Office Based centers are unregulated. The regulations also vary within a state depending on whether the facility is an Office Based Surgery, a Single Specialty Surgery center, an ASC, etc. Generally, it is difficult to impossible. Consult with more than one health care attorney in your area, and then check the state regulations yourself.
